תקנון אתר

מבוא

ברוכים הבאים לאתר האינטרנט [שם האתר] (להלן: “האתר”), המופעל על‑ידי טלי סבג בע״מ (להלן: “החברה”). כל שימוש באתר, לרבות גלישה, צפייה בתכנים או רכישת מוצרים, מהווה הסכמה לתנאי תקנון זה. החברה רשאית לשנות את התקנון מעת לעת, והשימוש באתר לאחר שינוי התנאים מהווה קבלה של התקנון המעודכן. הניסוח בתקנון בלשון זכר נעשה לשם נוחות בלבד אך מופנה לשני המינים.

2. השירותים והמוצרים באתר

2.1 האתר מספק מידע והשראה בתחום עיצוב הפנים ועוסק בשיווק מוצרי דקורציה וניחוחות לבית, כולל נרות ריחניים, מפיצי ריח ובשמים לבית, וכן מוצרים נלווים אחרים.
2.2 החברה שומרת לעצמה את הזכות לעדכן, לשנות או להפסיק את היצע המוצרים והשירותים בכל עת, לפי שיקול דעתה הבלעדי.
2.3 הזמנות תתאפשרנה ללקוחות בני 18 ומעלה בעלי כרטיס אשראי ישראלי תקף או אמצעי תשלום אחר, כפי שיופיע בעת ההזמנה.

3. אופן הזמנה ותשלומים

3.1 הזמנות באתר יתבצעו באמצעות מילוי טופס הזמנה מקוון או יצירת קשר טלפוני/דיגיטלי, כפי שיפורט בעמוד הרכישה.
3.2 מחירי המוצרים כוללים מע”מ, אלא אם צוין אחרת. בעת ביצוע הזמנה יופיעו אפשרויות הסליקה המאובטחת; פרטי תשלום יעובדו על‑ידי ספק סליקה חיצוני העומד בתקני אבטחה מחמירים.
3.3 החברה רשאית לסרב לאשר הזמנה, בין היתר במקרה של טעות בהזמנה, חוסר מלאי, או חשד לשימוש לרעה.

4. ביטולים והחזרות

4.1 מדיניות הביטול והחזרת מוצרים מתבצעת בהתאם לחוק הגנת הצרכן, התשמ”א‑1981, ולתקנות הגנת הצרכן (ביטול עסקה), תשע”א ‑ 2010.
4.2 ניתן לבטל עסקה ולהחזיר מוצר תוך 14 יום מיום קבלת המוצר (או במסגרת אחרת המחויבת בחוק), ובלבד שהמוצר מוחזר באריזתו המקורית וללא שימוש. החזר כספי יבוצע תוך 14 יום ממועד קבלת המוצר בחזרה, בניכוי דמי ביטול בסכום של  100 ש״ח או 5% (הנמוך מביניהם) .
4.3 מוצרים שיוצרו בהתאמה אישית ללקוח אינם ניתנים להחזרה, אלא אם נפל פגם בייצור.
4.4 החברה רשאית לבטל הזמנה ולהשיב את מלוא התשלום במקרה של חוסר זמינות במלאי או תקלה לוגיסטית.

5. זמינות, אספקה ומשלוחים

5.1 זמינות המוצרים באתר כפופה למלאי עדכני ולטבלת זמני העבודה של החברה.
5.2 אספקה תבוצע באמצעות אחת האפשרויות הבאות:
    ▪ איסוף עצמי מכתובת הסטודיו בתיאום מראש.
    ▪ משלוח לנקודת איסוף.
    ▪ משלוח עד לבית הלקוח באמצעות חברת שליחויות.
5.3 זמני אספקה משוערים ועלויות משלוח יצוינו בעמוד ההזמנה. החברה אינה אחראית לעיכובים שנגרמים בשל אירועים שאינם בשליטתה (כגון עיצומים או מזג אוויר קיצוני).
5.4 במקרה של עיכוב חריג, הלקוח יהיה רשאי לבטל את ההזמנה ולקבל החזר כספי.

6. אחריות והגבלת אחריות

6.1 המוצרים והשירותים המוצעים באתר מיועדים לשימוש ביתי. החברה אינה אחראית לנזקים עקיפים, תוצאתיים או שיגרמו משימוש בלתי סביר במוצרים.
6.2 התוכן באתר נועד לספק מידע והשראה, ואין לראות בו ייעוץ מקצועי מחייב. משתמש המתבסס על המידע עושה זאת על אחריותו הבלעדית.
6.3 החברה אינה אחראית לתכנים ותגובות שמפרסמים המשתמשים.

7. אבטחת מידע ופרטיות

7.1 החברה מחויבת לשמור על פרטיות המשתמשים ולעמוד בחוק הגנת הפרטיות. הנתונים האישיים שייאספו (כמו שם, כתובת, כתובת אימייל וטלפון) ישמשו לצורכי טיפול בהזמנות, ניהול חשבון, שיפור השירות ותיעוד בלבד.
7.2 נתונים לא יימסרו לצדדים שלישיים ללא הסכמת המשתמש, אלא אם יידרש הדבר על‑פי דין או מכוח צו בית משפט.
7.3 האתר עושה שימוש באמצעי אבטחה מתקדמים כדי להגן על הנתונים. עם זאת, אין ביכולתה של החברה להבטיח חסינות מוחלטת מפני פריצות, והמשתמש מאשר כי לא תהיה לו כל טענה בגין נזק עקיף שייגרם כתוצאה מכך.

Any use of the Website, including browsing, viewing content, or purchasing products, constitutes agreement to these Terms and Conditions. The Company reserves the right to amend these terms from time to time, and continued use of the Website following any changes constitutes acceptance of the updated terms. Use of the masculine pronoun is for convenience only and refers to all genders.

2.1 The Website provides information and inspiration in the field of interior design and markets home decor and fragrance products, including scented candles, diffusers, home perfumes, and related accessories. 2.2 The Company reserves the right to update, change, or discontinue the range of products and services at any time, at its sole discretion. 2.3 Orders are permitted for customers aged 18 and over who hold a valid Israeli credit card or other payment methods as displayed at the time of order.

3. Ordering and Payments

3.1 Orders shall be placed by completing an online order form or via telephone/digital contact, as detailed on the purchase page. 3.2 Product prices include VAT unless otherwise stated. Secure clearing options will appear during checkout; payment details are processed by an external clearing provider meeting strict security standards. 3.3 The Company reserves the right to refuse an order in cases of errors in the order, stock shortages, or suspicion of misuse.

4. Cancellations and Returns

4.1 The cancellation and return policy is conducted in accordance with the Consumer Protection Law, 1981, and the Consumer Protection Regulations (Cancellation of Transaction), 2010. 4.2 A transaction may be canceled and a product returned within 14 days of receipt (or as otherwise required by law), provided the product is returned in its original packaging and has not been used. A refund will be issued within 14 days of receiving the returned product, minus a cancellation fee of 100 NIS or 5% (the lower of the two). 4.3 Custom-made products manufactured specifically for the customer cannot be returned unless there is a manufacturing defect. 4.4 The Company may cancel an order and provide a full refund in the event of stock unavailability or a logistical malfunction.

5. Availability and Shipping

5.1 Product availability is subject to current stock and the Company’s working schedule. 5.2 Delivery will be carried out via one of the following options:

• Self-pickup from the studio address by prior appointment.

• Shipping to a pickup point.

• Home delivery via a courier company. 5.3 Estimated delivery times and shipping costs will be indicated on the order page. The Company is not responsible for delays caused by events beyond its control (e.g., strikes or extreme weather). 5.4 In the event of an exceptional delay, the customer shall be entitled to cancel the order and receive a full refund.

6. Liability and Limitation of Liability

6.1 Products and services offered are intended for home use. The Company is not liable for indirect or consequential damages, or damages resulting from unreasonable use of the products. 6.2 Website content is intended for informational and inspirational purposes and should not be considered binding professional advice.
